1. Acceptance of Terms

By accessing or using TakeCheck ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you do not have permission to access the Service.

2. Age Restrictions & COPPA Compliance

The Service is strictly intended for users who are at least 13 years old. We do not knowingly collect personal information or video data from children under 13. By using the Service, you represent and warrant that you are at least 13 years of age. If a parent or guardian wishes to use the Service for a student under 13, the parent or guardian must operate the account, record the video, and upload the content on the child's behalf.

3. User Content & Intellectual Property

Ownership: You retain all ownership rights to the videos, audio, and content you upload to TakeCheck. We claim no ownership over your musical performances or likeness.

License to Process: By uploading a video, you grant TakeCheck a temporary, limited, worldwide, royalty-free license to host, store, and process your video strictly for the purpose of providing AI-driven musical feedback. This includes securely transmitting your video to our third-party artificial intelligence partners (such as Google / Gemini) for technical analysis.

4. Privacy & Data Retention

Zero Data Selling: We do not sell, rent, or lease your raw video files, facial data, or personal identifiers to third-party data brokers or advertisers.

Auto-Deletion: To maximize your privacy and minimize security risks, TakeCheck employs a strict data-minimization protocol. Practice videos uploaded to our servers are automatically and permanently deleted within 24 hours of upload. TakeCheck is an analysis tool, not a cloud storage provider. You are responsible for backing up your own videos prior to upload.

5. Acceptable Use & Prohibited Conduct

You agree not to use the Service to upload, transmit, or share any content that:

• Is sexually explicit, obscene, or contains nudity.
• Promotes violence, harassment, hate speech, or illegal activities.
• Infringes upon the copyrights, trademarks, or intellectual property of others (e.g., uploading commercial movies or non-practice-related media).
• Contains malware, viruses, or attempts to reverse-engineer the Service.

Violation of these rules will result in immediate termination of access and, if legally required, reporting to relevant law enforcement authorities.

6. Disclaimer of Warranties

The Service, including the AI-generated feedback, is provided on an "AS IS" and "AS AVAILABLE" basis. TakeCheck makes no warranties regarding the accuracy, reliability, or physical safety of the musical advice provided. Musical practice involves physical movement; TakeCheck is not responsible for any physical strain, repetitive motion injuries, or damage to instruments that may occur during your practice. Always consult a human professional for medical or advanced technical guidance.

7. Limitation of Liability

In no event shall TakeCheck, its founders, or its partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of data, loss of use, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
